Because some kids are more mature than others, and therefore understand the difference between what's real and what's not. If there were like gratuitous torture scenes or EXTREME violence or rape scenes, I wouldn't let my kid play it. Really the farthest the Walking Dead game has gone is when Clementine is stitching up her arm or one character that was impled to be a sex slave. So, if the kid's mature, I'd let him play it.
