No. It's not. TELL TALE SAID THAT EPISODE ONE GOT SPLIT INTO TWO. Ties that bind part one and Ties that bind part 2… more. It's one episode split into two. So therefor Episode 3 is really episode 2

It was just awkward marketing meant to pass off the one-month delay of Episode 1 (without delaying Episode 2) as a good thing. They were otherwise going to be separate episodes, otherwise it would've initially been revealed to have only been a four episode Season if they genuinely had "split" the episodes that late into production.
The only other alternative is that they cut out an entire episode's worth of content just to "split" Episode 1 into two parts, which makes even less sense (keeping in mind that New Frontier was early on said to be a normal five episode Season).

They are a company that does wrong, ALL companies do wrong, but making a game isn't as easy as snapping your fingers, so stop complaining about stupid things.
You don't know what's going on behind the scenes, you don't know the reasoning for the shorter episodes, yet you claim to without any proof.

I never said it was. I mean it took EIGHT writers two years to come up with a five minute flashback.
Stupid things being what? Lack of season 2 or 1 choices mattering? Of Clem being the same in every playthrough? Of there being no alteration of dialogue with people.

It's two episodes in, and if you don't remember, Season 2 didn't feature a lot of past choices in the game, other than a few nods, which Season 3 did as well. (Clementine's scar).
You can choose to complain of a game that's only 2/5ths done, or you can wait until the next episode where Telltale has gotten ALL our feedback and input and see how much better it is.

Well considering they'll only be paying attention to positive feedback, considering Job has said the people who expect our choices to change anything don't get their games as it's what happens in your heart and mind that matters. And that the only way we effect the story is dialogue, and how that changes character perceptions, even though it doesn't. There are 8 writers and they've put no effort into developing characters or having branching dialogue options.
No matter what you choose people will always love Javier. No matter what you say they will always reply the same way.
Clementine acts the same regardless of past choices even though we were told it would change.
Oh and then there was the lazy end to Episode 1 part 2 where Conrad threatens to shoot Gabe no matter what you choose. Oh and spoilers. Conrad will have little dialogue or anything to do as once you're determinant they do nothing with them. He'll die Episode 2 or 3.

You couldn't of waited one day. Conrad lives in Episode 3 depending on your choices, believe it or not he is now A DOUBLE DERTERMINANT character, meaning he has two possible deaths and can still live, in fact, Conrad even was finally able to complete his story arch as well.
Why did you have to judge so soon, it turns out Telltale did a determinant better than any other time since Season 1 with Carley and Doug.
