This sums up my decision to choose Danny. While I don't condone his crime, Danny is friendlier, more moral, and much more trustworthy than Jus… moretin. I would never put him within 30 feet of Clem though. I take Justin as a person that would betray you and not feel any guilt or remorse over it. That makes him much more dangerous as a traveling companion.
In my playthrough I picked Danny only because he seemed more innocent than Justin. Said he didn't do it and that he was missing his girlfriend and that while Justin admitted what he did and didn't care about anybody he screwed over. Didn't regret leaving him till Russel said he was glad Danny had bought it.

Both had pro's and coins but in my first save I originally saved Danny. I don't think he was necessarily guilty of rape. I think he maybe met a 15 year old girl all done up and in a bar therefore he would believe she was 18+ and if she consented well how would he know any different? At least that's the way I prefer to look at it to justify saving him. Ofcourse I didn't really take the crime into consideration because based on the crime, I would totally choose the conman every time. However Danny seemed more trustworthy and actually seemed to care whilst Justin flat out admits he doesn't care so I was led to believe he would bail... and surprise, surprise, he does.
However I'm kinda glad that Danny dies either way. Don't get me wrong, I'd love for him to redeem himself but as much as I'd want to trust him, I would be worried to have him around the girls in the group knowing what I know. Ofcourse Vince was the only one to stay behind in my playthrough so I played again in a new save and did all the opposite choices and everyone joined Tavia.
Justin was an open and unrepentant liar and con man. I really didn't want someone like that watching my back. Figured he would screw me over the moment he saw an advantage in it for him.
Danny was a rapist...possibly. The choice would have been much easier, and not in his favor, if I knew for sure. He claimed he was innocent, which doesn't necessarily mean anything, but might have been true. People do end up going to prison on false charges sometimes. Regardless, outside of his informed status as a rapist, he seemed like a much more decent person than Justin, making a (futile) effort to stop the guy from being strangled while Justin was saying they shouldn't get involved. He also seemed more likely to be of use in a survival situation.

However, when I had the gun in my hand and was trying to determine who to shoot, I noticed that every time I swung my gun on the other two they made a new comment. Since there was no timer on the decision, for ONCE, I decided to listen to all the comments they made. I kept going back and forth between the two until Justin said this,
"I have a little brother too."
PERFECT! Play on Vince's brother complex in order to stay alive. Sounded like a legit roleplaying reason, so I swung my gun around for the last time and shot Danny's foot off.
Of course, Vince lies and lies well. He's pretty good at that, as his previous millions demonstrate. I wonder what lie a professional con man could possibly think of to make the guy with the shotgun not shoot him, after that guy with the shotgun just related a sad story about his little brother?

I saved Danny. He stood up to the guard and avoided any possible bloodshed. Although I had to rewind and save Justin, because I wanted everyone to go to the camp.
Danny may have seemed more physically capable and friendlier, but he was also dumb as a bag of hammers. You know who else was a well-meaning guy who ended up getting us into tons of shit with his stupidity? Ben.
I wouldn't trust Justin as far as I could throw him, but at least he had brains. You can toughen up your physical state with time and practice, but there's no cure for lack of intelligence. Frankly, I'd ditch either of them if I were Vince, but it seems to me that Justin would be the least likely to get me killed right out the gate.
I'm not even getting into the rape stuff. It's apparent to me that Danny did indeed commit the crime, but is too foolish to understand that consent from a fifteen-year-old is still statutory rape because of how easily young teens can be manipulated.

Danny wasn't honest. I think he said "She wanted it" yet he already said he didn't do it
I didn't say he was honest. I just felt that he wasn't as bad as Justin.

Even if you spared him in the bus, Danny is already dead by this time in the story. He died sometime after he and Vince met up with Russel.
