That's just it, Ben OBVIOUSLY died. Kenny, in both scenarios, goes off screen and they make it overly ambiguous in both scenarios. Now, if we heard a ripping noise, yelling, and saw his bloody mustache flop over the gate and land next to Lee, then there wouldn't be much room for discussion.

How could Ben still be alive. You could either drop him in a zombie infested Crawford or have Kenny shoot Ben. It is also clearly obvious Kenny shot him in the second outcome.
If you don't shoot walkers in the mansion, and you have bullets left, you can say "Okay" to Kenny and give him more bullets. It only does this if you saved Ben in ep.4.
