Actually this isn't too far off from what Telltale had planned for Kenny back in Season 2 before the Re-Writes happened. Kenny was suppose to take up the Role that Carver wound up taking. Only difference is that it's Javier we're talking about.

So bef… moreore I reply to some of your comments I want to make a few things clear. Just because Telltale said Javier is not returning that does not mean he is not returning. Javier is meant to be very surprising, Telltale doesn't want to tell anyone Javier is returning because it ruins the surprise, so instead they just say he isn't returning at all. Telling people Javier is in the game before release ruins the surprise, also I am very positive Javier is the only member of the Garcia family to return so no Gabe, Kate, or David. Just Javier.
Next about the "hook hand." I probably should have said this better. It isn't a hook like a Captain Hook Hook but more like a spear I suppose. The way I wrote this is just meant to summarize the plot. And no I am not an employee of any kind or a writer.
It's not my story so I can… more't really ruin it. The Javier surprise is pretty good in my opinion once you see it play out. However, I will agree that him having his hand cut off seemed like a strange decision to do. My best guess is episode 2 will explain why Javier is after Clem, but I do not know anything about episode 2.
