    Sort of, if Max suddenly didn't have a soul.

    Well, since Max is a rabbit and that toothpick holder is a rabbit, I'd say that's a fair assumption.

    It kinda looks like Max, but the idea of pulling Max by his ears out of a top-hat to present you some toothpicks seems wrong. If Max got hold of some toothpicks, I'd recon he try to see how many would fit in your eye or something like that, especialy if you pulled his ears.(I have a vague memory of Max realy hating that)

    Of course, if Telltale made one those of those, it would be of Jimmy Two-Teeth, for obvious reasons.

    Or mabye Sam and a voice box that gives random lectures why you should brush your teeth. uh come to think of it no Sam toothpic holder to boaring (besides who whants to here Sam give lectures?)
