I think Telltale should've let the player choose a name for him. I was waiting for an option like this.

If you shoot Kenny, even if Clem was an adult, if there were people watching she would not be convicted of murder. She would be seen as a person that saved somebody else's life.

Kenny committed an unlawful KILLING, which is what differentiates it from a LAWFUL killing. Which is what this whole discussion has been about all along, the difference between a lawful and unlawful KILLING. You saying "What Jane did wasn't lawful!" has nothing to do with the argument at hand.
Second off, If you're trying to somehow justify Kenny murdering Jane because she was "ACTING unlawfully" well.. that's just wrong. You can't murder someone because they've broken the law (which she hadn't, technically.. nor did she pretend to have, she said it was "an accident"). Neither can you murder someone because they've physically harmed you. Kenny had no more right to murder Jane than a homeowner does if a burglar enters his house, or than a random person does in a bar fight.
