How does the game copyright work?

edited January 2013 in The Walking Dead
I'm currently making a music video tribute of the walking dead game and I think it is okay since youtube is full of other tribute videos and playthroughs and telltales even shared some of them in their facebook page.

So I'm just wondering if it is possible at all that a video like this can enter a contest. I have the contest description rules too from the band of the song I use and I just wanted to know if this kind of thing is even possible. The rules say the video can't have copyrighted material so does that mean I can't use gameplay footage?

Any ideas people?

Tricky. Strictly speaking, your use of the video would be "for gain" - although not financial gain. No idea if that's beside a fair use policy.

Ok. I still doubt highly that it could be possible. There are no prizes except for the first place. It would have been fun to enter the contest only to see how people compare it to other entries but it's not a big deal for me.

    Here it is:

"1. With the exception of the music you declare that your video is totally your work and does not contain, in whole or in part, any copyrighted work from any other source. You indemnify TBM and all of their employees from any and all actious arising out of your breach of this clause.

    2. You hereby give Metropolis Records and The Birthday Massacre the right to exhibit, transmit or present your work in perpetuity by any visual medium now known or hereafter comes into being or to refrain therefrom. Should Metropolis and The Birthday Massacre choose to do any of the above, you will receive full on screen credit for your work. When you submit your for the contest you must also tell us how you wish to be credited."

Although it says no copyrighted work the second part says it would be credited.

err, 1. pretty much nails it. You can't use game footage.
the second part only says you will be credited for YOUR work. it has nothing to do with #1

Okay then I won't be entering any contest. I will still do the video though.
