You will instead be lowered to a different tiers, and placed with guys who stole something only worth a couple hundred bucks, and the guys who didn't pay their alimony one to many times.
Since he is with a convicted murder and a thief who has stolen millions I'm assuming he actually raped the girl. But this is just coming from a guy who loves mystery and true crime novels, not a lawyer.

It's more complicated then that. The US has multiple different "tier" levels. If a guy is being sent to a maximum security prison for sleeping with an underage girl it's usually because he raped her.
Other things can also be a factor, like the poor kid is only nine or something, or the guy has done it multiple times.

My favourite chacter stories in order of what I felt were the best would be;
1) Shel's story. It felt longer to me than most of the others and I felt more invested in her character. I finished it feeling happy with my choices and generally found the episode most satisfying, again probably because of the length. I liked the jump scares in the episode with Becca and when you got close to the chained walkers.
2)Russell's story was my 2nd favourite again because it felt like one of the longer episodes. What I liked is that the game let me say what I was feeling whilst watching the characters and let me do or at least attempt to do what I would have wanted to in that situation such as threatening to kill Nate for putting him at risk with the female walker and later drawing the gun on him, then later telling him how I thought he was crazy and that I didn't want any part in what he was doing.
3)Wyatt's was my 3rd favourite. I found it tense and liked the fog effect. It made me feel lost, then when Nate showed up I felt screwed, panicked and actually ended up dying. Up to now i'm not sure what happened but it seemed like I ran out of bullets or maybe because I was trying to shoot Nate but I got attacked by walkers because I was distracted by Nate's arrival. I enjoyed it more on my second play through. On my first play through I found it hard to follow what was going on and to read the dialogue choices in time. I wasn't sure if Wyatt was a good guy or not since I wasn't sure why they were being chased. I found the story too short to get a good sense of the character and what was going on in his life.
4) 4th place is a tough one but I'd give it to Bonnie's story just because Vince's story felt too short and linier. Like Wyatt's her story was tense because of the cornfield chase and the new item pick up game mechanic which added tension. I died during that level a couple of times because I got caught by Roman or killed by Dee. It had a cat and mouse chase feel to it that broaught a horror element to it like when the Governor was chasing Andrea in the tv series.
5) I liked Vince's the least. It was so short that I now feel I misunderstood the character in my first playthrough. Initially I saw him as a murderer, someone who killed in cold blood and the opposite of Lee who hadn't planned to kill the senator but just lost it in the heat of the moment. When I saw Vince on the bus because of the way I perceived him I deliberately made him villain like, making him choose rude responses to the other prisoners and the guard when he did speak and had him ignore and blank them most of the time. I instintively made him unsympathetic, selfish and had him intimidate the others by bragging of his murder. Before I knew it the episode was over and Vince bearly spoke. On my second playthrough I made him pretty much the same but I didn't say what he was in for I just ignored them but this version of Vince was regreting what he had done since my perception of him changed once I realised he was trying to find his brother and may not have been some criminally minded gangster but again it was too short for me. The only decission I felt happy about was shooting the rapist because I didn't want him popping up in the story later on in season 2 when Clem would be around.

Not rape in the savage sense or the physically forcefull rape but statutory rape in that the person is getting with someone below the age of legal consent. I'm sorry man, but that's just messed up, natural urge or not. Those urges should be resisted. I mean let's say the girl Danny was with consented she may have been groomed, manipulated and mind fucked first into thinking she loved him.

1. Bonnie - Cool chase scene in the cornfield and I simply liked how it was so crazy plus I liked the character relationships as it was something we hadn't really seen before

1: Russell - By far the best. Nate made this story. His dialogue with Russell was fantastic and the action was really gripping. 2: Shel - Reminded me of the motel camp in Season 1. I loved that tension between Lily and Kenny and it seemed familiar here. Also, Becca reminded me of Clementine... if she was bloodthirsty. 3: Vince - It was okay. Don't understand why so many people were in love with Vince's story. I honestly think it's because they like the character and that's it. The dialogue wasn't all that amazing to me and the choice wasn't that hard to make (I picked Danny). 4: Wyatt - Eh. Not really interesting. 5: Bonnie - Hated it. It's set up with lame lobster jokes and next thing I know, I'm hoping back and forth in a cornfield like a monkey trying not to get shot. Ending seemed like a twist copout too and there was no emotion because I HATED EVERY CHARACTER IN IT.

Not to mention the whole "friend of the family" thing and having to decide on killing her or not.
Heck, they even got art thrown in (however brief it was), and that's one of my favorite subjects.
2. Bonnie - It was pretty atmospheric, and I love that it can be altered a bit depending on whether or not you killed the zombie in Russel's story. There was something about the whole circumstance and cornfield that made this feel like a fresh story for The Walking Dead universe, and it reminded me a lot of Who Goes There? Dunno why it does, but the uncertain tone and frantic chase just echoed the story a bit for me.
3. Wyatt - This is probably the funniest story in the entire series so far, and it does hold up some horror aspects at the same time. That whole truck reveal (Nate) was done in such an incredible manner, that I can't wait to see what other kind of visual cues they use for the next season. Wyatt and Eddie were pretty likable, and I loved the bromance going on, and the hilarious responses are great.
4. Russel - Nate made this story. Russel didn't seem to be much of a person in this, but the psycho and unpredictable nature of Nate really sold this one. It would be much higher on the list if I actually felt a connection to Russel, but he...I dunno, was a little too whiney and yet somehow calm at the same time for my taste, so I felt a little annoyed by him more than anything.
I think he's got potential in season two, but here it seems Nate got all of the focus, and Russel's character suffered for it.
5. Vince - Don't get me wrong, I liked it, but damn if I was kind of bored. I actually wanted to see more of the story taking place before the beginning of the zombie apocalypse. I wanted to know more about Vince's brother, and who he shot, and not just the ambiguous why of the shooting. I also laughed at the "What the fuck did you do boy," or one of the lines from the bus driver. The timing and voice actor made it hilarious, and I'm not sure if that was the intent or not.
6. Tavia.
Does she even count? She's more or a less a tease, and lead in for where the story might or might not be going. Plus, there wasn't much of a conflict, other than should they stay or should they go. As far as I'm concerned she's just a framing device that ties every survivor together. She has yet to earn character status for me, and I'm sure that will change once season two hits.
I loved the cast of 400 days, for the little screen time they got with the DLC I was still more intrigued with them than I was with the original TTG TWD cast. Going forward, provided all 5 characters make it to season 2 I think for me that the 400 days cast is just a little more varied and quirky.
1: Russell - LMAO, this was a blast, mostly just seeing the shock on his face and the way he and Nate interacted with each other. I liked Russell, he's a little naive but he isn't a total idiot like say Ben would be. She's a 10 OK!
2: Bonnie - Right away you could tell her and Leland had a thing going on or starting up. I also liked the fact that she was some sort of addict, adds a fresh take on the characters we've seen so far from season 1. Should be interesting to see where lying to Leland gets you in season 2, bawmp chicka wa wa.
3: Wyatt - I loved this one because I can relate the most to Wyatt, lol. I agree the whole fog scene was really well done, Eddie's a bitch though.
4: Shel - This one had some serious issues to deal with made harder with Becca being in attendance. The interaction between siblings going in different directions in season 2 has some potential.
5: Vince - Not really sold on Vince being a criminal or bad ass as not much was given or shown and he just didnt feel like he had that criminal edge to him, like say how Nate or Roman does. He did have the balls to use the shotgun on one of his buddies so hopefully the character has some more edge to it in season 2.
Overall I can't wait for season 2 of TTG TWD to get here. Please have Nate involved in some way shape or form he'd make a great antagonist.

In the Shel episode,I decided to stay at the camp and not drive off, why would Shel and Becca leave? At the end of all the episodes, they were with the others. So let me ask this, why we making decisions if Telltale is just going to force our decisions against us?
