Russell doesn't say he's dead. He implies he's missing, but missing in a way where he's unlikely to be alive. Still, I think he's probably dead, but it's not a given.
I just finished my second playthrough of 400 Days, the first time around I shot Justin but this time I shot Danny instead. Later, during Bonnie's story, I came to the part where she falls down a steep hill while being chased and noticed something interesting. During my first playthrough (where I shot Justin) there was a zombie at the bottom of the hill that attacks Bonnie, but during my second playthrough (after shooting Danny) the zombie did not appear at all!
I think that there's a pretty good chance that Danny is still alive... and he's probably VERY angry. :eek:

Did you play the Russell walkthrough first? Because if you kill the cop zombie there there will not be the cop in Bonnie's playthrough. In fact to my knowledge her play through is the only one where you have the potential to see no zombie.
It wasn't their crimes but it was their personality. Justin seemed very arrogant and boastful about his deed and seemed to force an argument towards Danny while Danny told the truth in court and seemed to be a first time offender... even if it was for rape. Danny was sorry, Justin was proud.
That, and it was life or death and I had to pick in what felt like a spit-second.
who would you rather keep alive someone who will break into your house and steal all your shit or someone who will break in your house and rape your daughter
I shot Danny, because I had a suspicion that maybe this would be the group that finds Clementine in season 2, and I didn't want Clem-Clem to be raped. No thank you.
Of course Danny dies anyway, so it didn't matter in the end.

I don't think Lee planned to kill the senator though. I think he lost his temper and killed him during a struggle. I don't remember hearing a gun shot when Lee had his nightmare about the incident whilst sleeping in the barn. I think the sound of broken glass was the sound of them brawling. The fact that he even has nightmares about it says something about how he felt about it where as Vince has the option to brag about being inside for killing someone. So I think with Lee it was a mistake and with Vince it was intentional. Hence why Lee wasn't in an orange jumpsuit going to a maximum security prison, shackled up like Vince but was just being escorted in a police car with handcuffs to a normal jail.
Well. You know that if you choose to kill the Stranger in episode 5, you're basically doing the same as Vince. Killing a person to protect someone you care about. And yea, the option to brag. Why not brag to them? Jeez... you're heading to a maximum security prison. Why would you try to seem like a nice guy? It's better to behave like a tough guy, and not make yourself a target. Lee doesn't brag about it due to the fact that he doesn't have to deal with other "potentially" dangerous criminals. If you make yourself seem like a wimp, who would they take out if they got the chance?
I did however choose Vince's part last, so I could just go back and fourth changing who I saved here. It's kind of sad when I see the other dialog options. If you shoot Justin, apparently Wyatt met them both. In witch Wyatt thinks that Danny was a jerk, and he says that he's dead. Witch in fact means that Danny would end up dead anyway. However, Vince seem to have had a good time with Danny, and Danny stuck with him til he died. However, I guess we would never see any of that. And it's hard to know how it affects the story if all goes with Tavia or not either. Russell could even be right for what we know. "It's going with her that get us killed". I see that Justin actually ditch Vince, but Justin may actually be alive. He's not confirmed dead. You may actually get a chance to know Justin a bit better too, if he's still alive.
