The game was made 90% by 3D Realms then Triptych Games finished off the rest of it (who were all ex-3DR employees from the layoff last year). Then the game was polished and ported to 360 and PS3 by Gearbox with help (again) from Triptych Games. A lot of ex 3DR employees also work at Gearbox now. But Gearbox didn't do basically anything to DNF. They're just getting it out the door.
Also, Gearbox was sold the Duke Nukem franchise rights.

That's not entirely true. They no longer have a dev team and don't make games in-house anymore, but they are still very much alive as a game company. They recently re-released Duke Nukem Manhattan Project for XBLA and also Rise of the Triad and Duke3D on iPhone.

1995? Conker's Bad Fur Day came out in 2001, and that's easily as vulgar and risque as DNF, maybe moreso. Resident Evil 4 came out on the Gamecube in 2005, and that involves decapitations and worse. Yes, it's rare, but Nintendo has allowed it on a couple of occasions.
It's not just violence DNF has. It's loaded with mature sexual content as well. Did you watch the trailer? There's no way that's going on the Wii. Besides, they would have to re-engineer it and downgrade it specifically for the Wii and they're not gonna do that. It was originally not going to come to PS3 either before the lawsuit, and the Gearbox stepped in, got DNF back on its feet and also decided to port it to the PS3 because they're that awesome.
I actually hate that song. I wish they would've used Grabbag or some other generic metal track over that techno garbage.
For all honesty, I do too. Computer generated garbled track that I would never pay attention to listen to. But it's associated with two things that I like.

It is, but now the game has a chance to be released and for us to enjoy it as well.
I don't think it will affect the DS and PSP Trilogy, in fact I didn't know they were still being released.
